Court Gives Buhari 5 Days To Respond To Alleged Certificate Fraud

The Court of Appeal Abuja division on Monday ordered President Muhammadu Buhari to respond within five days to the appeal filed against his qualification for the 2019 presidential election.
The court also ordered the All Progressives  Congress (APC), and the Independent National Electoral Commission (INEC) to within five respond to all issues raised on the educational qualification of the president in the election.
Justice Datti Yayaya who issued the order also directed that Buhari’s counsel, Mr. Abdullahi Abubakar, to within the period file necessary processes in relation to the appeal.
The appeal was filed by  Agu Kalu, Labaran Ismail, and Hassy El-Kuris.
The decision of the appellate court was sequel to a motion on notice filed by counsel to the appellants, Mr. Uchenna Ndubuisi.
Ndubuisi prayed the Court of Appeal in the motion to abridge within which Buhari, APC, and INEC will join issues with the appellants on the certificate suit.
Abubakar and Mr. Temitayo Lasaki counsel for APC had urged the appellate court in their response to the motion to give them five days to enable them to file their respondents’ brief of argument along with other processes so as to set the stage for the hearing of the substantive appeal.
Kalu, Ismail, and El-Kuris had approached the appellate court to nullify and set aside the Judgment of the Abuja division of the Federal High Court.
The lower court had declined to hear their suit instituted to challenge the educational qualification of President Buhari before the conduct of the 2019 general election.
The appellants in their appeal are asking the appellate court to reverse the judgment of Justice Ahmed Mohammed on the grounds that the processes filed by Buhari and used to strike out their suit were not competent.
While faulting the Judgment of the High Court, which was predicated on the grounds that the suit was statute barred, the appellants claimed that the Federal High Court erred in law and in its decision.
This they said was because they did not challenge the primary election that produced Buhari as the candidate of the APC.
They, therefore, urged the Court of Appeal to assume jurisdiction over the suit and grant all the reliefs sought at the Federal High Court but which were refused.
Among the reliefs were a declaration that Buhari submitted false information regarding his qualification and certificate to INEC for the purpose of contesting election into the office of the President of Nigeria and that he should be disqualified.
They also prayed for an order of the court directing INEC to remove Buhari’s name as a candidate of APC.
Also, an order restraining Buhari from parading himself as a candidate in the 2019 presidential election and also APC from recognizing Buhari as a candidate.
The Federal High Court had on May 2 declined to grant the request of the appellants on the grounds that the suit was not filed within the time allowed by law and therefore sustained the preliminary objection raised by Buhari at the hearing.
But not satisfied, the appellants are now asking the Court of Appeal to grant their reliefs because they are not challenging the primary election of APC as erroneously held by the lower court.
They said they are challenging the qualification of Buhari to stand for the presidential election without demonstrating his educational certificates as required by law.
July 8 was fixed for hearing of the appeal, the News Agency of Nigeria (NAN) reports.

could not independently verify the figures being mentioned, but a security source said it was "highly possible", considering Baga is the headquarters of the Multinational Joint Task Force (MNJTF) — a formation comprising units, mostly military, from Benin, Cameroon, Chad, Niger, and Nigeria, and boasting between 7,500 and 10,000 personnel.
A security source confirmed the attack and the disappearance of “a high number of soldiers”.
“So many soldiers, likely in their hundreds, are missing,” he said. “Even the Baga Brigade Commander is back in Maiduguri, which means he must have escaped when he saw that his team was overwhelmed.”
The source also confirmed that the insurgents set the MNJTF headquarters ablaze, and made away with military equipment.
The Army, though, continues to deny that the town has been overrun by insurgents.
In a statement released on Friday, Sani Usman, Director of Army Public Relations, said the sidurgents were the ones fleeing.
“Please recall that yesterday, Wednesday 26th December 2018 suspected Boko Haram terrorists attacked the headquarters of 7 Brigade Multinational Joint Task Force (MNJTF), Baga, Borno State, at about 7.00pm,” he said in a statement.
“The troops along with their Nigerian Navy counterparts put up a very determined fight to repel the attack throughout the night, while Sector 3 Operation LAFIYA DOLE sent in reinforcement who are in hot pursuit of the terrorists. Similarly, a Search and Rescue team has been constituted.
“The Nigerian Air Force component has also been mobilised and are engaging the fleeing terrorists. Unfortunately, a naval personnel was killed in action. So far, no further details of casualties yet as efforts are ongoing to clear the terrorists hiding in Baga and environs.”

EXCLUSIVE: 190 Policemen Mobilised For Boko Haram ‘Without Training’ Escape From Police Force

At least 190 policemen being mobilized for the war against Boko Haram have fled for their lives.
Worried by the development, the Force Headquarters, Abuja, has ordered for the arrest and prosecution of the officers.
A security source familiar with the matter told SaharaReporters that the said officers were to be sent to battle without appropriate training, and also observed that nearly all of them are southerners and Christians.
“Those are the names of policemen who were mobilised without any serious training to be sent to the front lines to fight Boko Haram who ran away,” said the source.
“Nearly all of them are southerners and Christians; 96% of the total number mobilised are southerners and Christians too. This has raised so much dust and outcry in the NPF.”
However, the Police presented a slightly different account of the incident. A ‘Police Wireless Message’ sent from the Force Headquarters to MOPOLS in 22 states, which was seen by SaharaReporters, said the policemen were being trained at the Special Forces school, Buni-Yadi, where they absconded from. The MOPOLS were urged to treat the matter as “very important”.
The 190 officers may have been intended to be part of the group of 2,000, which the Inspector General of Police, Ibrahim Idris, deployed to the North East late last month to fight Boko Haram.
Announcing the deployment, Force Public Relations Officer, Jimoh Moshood, had said the policemen comprised personnel of the Police Mobile Force (PMF) and Counter Terrorism Units (CTU), as well as those of the Force and the Sniffer Dog Sections.
Moshood also stated that the new deployment was consistent with Section 4 of the Police Act and Regulations.
The section, he said, “specifies the general duties of the Nigeria Police Force as follows: The police shall be employed for the prevention and detection of crime, the apprehension of offenders, the preservation of law and order, the protection of life and property and the due enforcement of all laws and regulations with which they are directly charged, and shall perform such military duties within or outside Nigeria as may be required of them by or under the authority of this or any other Act”.

2019 Budget To Wait Till After Elections – Lawmakers

Image result for nass nigeria
Some lawmakers on Sunday said it would be impossible for the National Assembly to start and complete work on the national budget before next year’s general elections.
They, however, promised to begin work on it when the National Assembly reconvenes in March or April next year.
According to PUNCH NEWSPAPERS, a member of the Senate Committee on Appropriation, Senator Abdulfatai Buhari, said it might be difficult to pass the budget before the elections.
He said, “When we resume in January 16, the President of the Senate will send the budget proposal to our committee.
“By that time the election will be getting closer and there would be discussions on the general principles of the document which could take up to two weeks. That means that we would have only two weeks to go.”
“What I can guarantee is that we will  conclude discussions on the general principles between the period of our resumption and the elections.”
The Chairman Senate Committee on Local and Foreign Debts, Senator Shehu Sani, also said passing the budget before the elections would be a  difficult task.
He said, “By the time we resume, it would be exactly one month to the general elections. Every committee will invite the heads of agencies under their oversight responsibilities to make submissions.
“We cannot achieve that because many of us will be campaigning.
“The only thing we can  achieve is to discuss the general principles of the budget.”
A Peoples Democratic Party lawmaker, who spoke on condition of anonymity, said the speedy passage of the budget would depend on the executive.
He said, “Since the executive arm of the government is aware that this is an election period, it should have submitted the budget earlier. The current administration has not treated the National Assembly like a critical arm of government.
“We know that there will definitely be allegations of budget padding against the federal legislature that is why we will take time to really scrutinise the budget proposals.
“As things are, there is no way we can  start any meaningful work on the budget until after the elections.”
However, a former Senate Leader, Ali Ndume, expressed confidence that the budget would be passed before the general elections.
He said, “We should be able to pass the budget before the elections depending on the content and the complex of the proposed fiscal document. We have done a similar thing before.
“We will  rely on the cooperation of  the  opposition lawmakers  to achieve it this time round.”
Also, some House of Representatives members said the budget would wait until after the elections.
The lawmakers also noted that the 2019-2021 Medium Term Expenditure Framework and Fiscal Strategy Paper is still pending before the National Assembly and must be passed before the appropriation budget could be considered.
The member representing Obio/Akpor Federal Constituency, Mr Kingsley Chinda (PDP), said, “I am sure that even the person ( President Muhammadu Buhari) who presented it knows that it cannot be passed before the elections.
“Firstly the MTEF was sent to us around late November and early December for consideration. Shortly after, the budget was dumped on us. The intention is just to make Nigerians to scream that the budget is before the National Assembly and we are delaying it.
“I am sure that the ordinary Nigerian knows that we cannot get the ministries, departments and agencies to appear before us during the Christmas break to defend the budget. The ministers are also involved in the elections, because they need to campaign for their boss. So, who will defend the budget.
“Reasonably, I don’t see the possibility of the budget being passed before the elections. Even where we decide to work, you cannot get the heads of the MDAs to defend the budget.”

Buratai: New army uniform sends signal when you are in danger

New technologies and application of drones in the campaign against Boko Haram insurgents in the north-east has been adopted says the COAS.

According to TheCableTukur Buratai, chief of army staff (COAS), disclosed this while fielding questions at a dinner and media interactive session organised for editors and defence correspondents in Maiduguri, Borno state capital.
Buratai said the applications of drones and new technologies were critical in modern warfare to ensure successful implementation of the counter-insurgency campaign.
He said the army had utilised drones in surveillance and research, adding that the process was effective in the execution of its operations against the dreaded Boko Haram insurgents.
Buratai said: “Now, even the uniform is technology-based, it will be tagged wherever you are; it sends signal when you are in danger, and these issues are very important.
“Technology is playing important role in warfare and we are not left out; we have in place a transformation and innovation department.
“The department is working on research and developments not only on basic equipment but equally more scientific and technological facilities to enable us to carry out our operations.
“We are also working on deployment of drones, the Nigerian air force has been deploying drones in our operations in the northeast and they are deploying more, it has been very effective in this operation.
“For surveillance, local drones are deployed and when new ones are also deployed, it will be effective and useful in the operation.”

Boko Haram Kingpin Arrested In Lagos

Boko Haram commander ‘arrested in Lagos’

Abdulmalik Umar, 39, was arrested by operatives of the Inspector General of Police Intelligence Response Team (IRT) headed by Abba Kyari, a Deputy Commissioner of Police (DCP), and his men had been trailing the one-eyed Umar since he entered Lagos three weeks ago. He was finally arrested around Mowe at a nurse’s house where he was receiving treatment for the bullet wounds he sustained during a recent gun battle with the police in Abuja.

According to THE NATION  the suspect, alleged to have masterminded the explosions at Nyanya and Kuje in Abuja in 2015, as well as several bank robberies in Ondo, Edo and other southern states, had fled Abuja three weeks ago when some of his gang members were apprehended.
A police source, who confirmed the arrest, disclosed that the nurse, who is said to be Umar’s sister, and her husband were also arrested for aiding and abetting criminality.
They eventually busted his hideout around 2pm yesterday.
It was also gathered that the suspect led the gang that killed seven policemen at Gwagwalada, Abuja.
Their AK47 rifles were carted away. He was also alleged to be behind the killings of policemen at Lugbe and  armed robbery at Galadimawa Roundabout, among others.
The source described Umar as an overall “commander” of bank robberies in the southern part of the country as well as mastermind of killings in Okene, Kogi State.
The source said: “He was also the one who brought all  the bombs they used during the Nyanya and Kuje attacks in 2015. We have arrrsted some of his members who are in court now. They were the ones who gave us his details and since then we have been looking for him.
“He has one eye and is responsible for over 200 killings. We arrested four of his gang members three weeks ago in Abuja and recovered four AK47 rifles which they took from the policemen they killed at Gwagwalada.
“He escaped at that operation with gun wounds and fled to Lagos. We have been on his trail since then. He went to his sister’s house in Mowe to hide. His sister was treating him of the bullet wounds.  We have arrested her and her husband too because they are accomplices.
“He was the Grand Commander of the attack and rescue operations of the Prison in Niger State early this year where he lost one of his eyes during the operation while over 100 prisoners escaped.”
Confirming Umar’s arrest, police spokesman Jimoh Moshood, an acting Deputy Commissioner said he would soon be paraded.
Moshood said: “It is true that he was arrested in Lagos. He fled Abuja with gunshot injury and was trailed to Lagos. We arrested some of his gang members three weeks ago and recovered weapons from them. They will be paraded soon.

Lawmakers Booed President Buhari As He Presents 2019 Appropriation Bill

President Muhammadu Buhari at the 2019 budget presentation to the National Assembly
President Buhari Presenting 2019 Appropriation Bill
President Muhammadu Buhari was given a rough welcome by a section of the joint session of the National Assembly on Wednesday as he gave the speech that was expected to culminate in the presentation of the 2019 appropriation bill.
Buhari entered the National Assembly at about 12:40pm and immediately set about the business of the day.
However, he was soon shouted down with screams of “nooooo”, “nooooo”, “lieessss” when he started talking about the strides of his administration.
The shout was loudest when Buhari said “the economy has recovered from recession”, and that Boko Haram had been degraded in the North-East.
At some point, the President got visibly angry, abandoned his prepared speech, and told the lawmakers: “Distinguished members, let us conduct ourselves properly. The world is watching us; we are supposed to be above this.”
This brought some decorum, but only for a while as the shouts resumed when Buhari spoke about the anti-corruption campaign of his government.
As the speech wore on, though, his supporters made themselves heard as well, standing, clapping and cheering as he reeled off figures of infrastructural projects.

Many of the lawmakers and party loyalists were seen thrusting their hands in the air, ‘stomping’ the ground excitedly and clapping along, as Buhari made his entry into the joint session.
Prominent among those pictured heartily cheering the President was Godswil Akpabio, a long-serving member of the opposition Peoples Democratic Party (PDP) and erstwhile Minority Leader of the Senate, who crossed to the President’s party, the All Progressives Congress (APC), in August.
